These Terms of Service (“Terms”) govern your access to and use of the website and the direct-access laboratory testing services offered by Proactive Functional Care (“Proactive Functional Care,” “we,” “us,” or “our”). By purchasing a panel, creating an account, or otherwise using our website (the “Site”), you agree to these Terms. If you do not agree, please do not use the Site or purchase our services.
Wellness testing — not medical care
Our lab panels are offered directly to you as a consumer for general wellness and informational purposes. Ordering or purchasing a panel does not create a practitioner-patient relationship, and your results are not medical advice, diagnosis, or treatment. Always consult a licensed healthcare provider about your results and before making any health decision. If you have a medical emergency, call 911.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site and purchase services. Testing for minors, where offered, must be arranged and authorized by a parent or legal guardian. Certain tests may be unavailable in some states due to applicable law.
2. Nature of the Services
We provide access to laboratory testing that is processed by independent, accredited laboratories. We facilitate ordering, collection logistics, and delivery of your results. We do not diagnose conditions, prescribe treatment, or provide medical care through this Site, and no results should be interpreted as doing so.
3. Ordering and Payment
Prices are shown on the Site and are due at the time of purchase. Payments are processed securely by our third-party processor, Stripe; we do not receive or store your full card number. You are responsible for any applicable taxes. If your blood is drawn at a participating walk-in laboratory rather than in our office, that location may charge a separate collection (“draw”) fee, typically $35–$45, paid directly to them at your visit; that fee is set by the collection site and is not included in or collected by Proactive Functional Care.
4. Scheduling, Collection, and Your Responsibilities
You are responsible for providing accurate information and for following all preparation instructions — for example, fasting requirements, morning timing for certain hormone tests, cycle-day timing for women’s panels, and the instructions included with any at-home collection kit. Results may be affected or delayed if instructions are not followed. Turnaround times are estimates and are not guaranteed, as they depend on the collection site and the processing laboratory.
5. Your Results
Results are released directly to you, the person who ordered them. Reference ranges are general and may not account for your individual circumstances. We strongly encourage you to review your results with a qualified healthcare provider, who can interpret them in the context of your full health picture.
6. Cancellations and Refunds
We begin fulfilling orders quickly, so refunds are available only before fulfillment starts:
- At-home collection kits (specialty tests): Your kit is ordered from the laboratory shortly after purchase — typically within 24 hours — and is non-refundable once it has been ordered or shipped. To cancel a kit order, please contact us within 24 hours of purchase.
- In-office or walk-in blood panels: Your order is refundable only if you request a refund within 7 days of purchase and before your specimen has been collected or processed. After 7 days, or once your specimen has been collected or processed, the order is non-refundable.
Except as stated above, purchases are non-refundable once fulfillment has begun, unless a refund is required by law. Separate collection (“draw”) fees paid to a walk-in laboratory are handled by that location under its own policies. To request a cancellation or refund, contact us at info@pfccare.com.
7. Third-Party Laboratories and Services
Specimens are analyzed by independent laboratories (for example, Diagnostic Solutions Laboratory and Precision Analytical), and payments are handled by Stripe. Your use of those services is also subject to their respective terms and privacy practices, over which we have no control.
8. No Warranties
The Site and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that any particular result will be achieved from testing.
9. Limitation of Liability
To the fullest extent permitted by law, Proactive Functional Care and its owner, staff, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Site, the services, or your reliance on any result. To the extent liability cannot be excluded, our total liability for any claim will not exceed the amount you paid for the specific service giving rise to the claim.
10. Assumption of Risk and Indemnification
You acknowledge that you are ordering testing on your own initiative and accept responsibility for how you use your results. You agree to indemnify and hold harmless Proactive Functional Care from claims, damages, and expenses arising out of your misuse of the Site or services or your violation of these Terms.
11. Acceptable Use and Intellectual Property
You agree not to misuse the Site, interfere with its operation, or attempt to access it in an unauthorized way. All content on the Site — including text, graphics, logos, and the Proactive Functional Care name and marks — is owned by us or our licensors and may not be used without our permission.
12. Privacy
Our handling of information you provide through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us in good faith to seek an informal resolution. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Ohio, and you consent to their jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” above and post the updated Terms on this page. Your continued use of the Site after the changes take effect means you accept the revised Terms.
