Effective date: 9/10/2026

Proactive Functional Care LLC (“Proactive Functional Care,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect through our website at proactivefunctionalcare.com and our lab testing pages (together, the “Site”), how we use and share it, and the choices you have.

What this Policy covers — and what it does not

Website and direct-access lab testing. This Policy governs information collected through the Site: browsing activity, contact and scheduling forms, and direct-access lab test selections.

Clinical care is separate. If you are a patient of the practice, the medical information created in that treatment relationship is confidential and is governed by Ohio law and our professional obligations as licensed clinicians, not by this Policy.

Direct-access testing does not create a practitioner-patient relationship. Tests purchased through the Site are ordered by you as a consumer, authorized through the laboratory’s own network physician, and released by the laboratory directly to you. We do not receive, interpret, or store your results. Because this information is not created in a treatment relationship, we protect it as described in this Policy and under applicable consumer health privacy law.

1. Information We Collect

Information you provide when you select a test

When you select a test, we collect your name, email address, phone number, and mailing address, along with the test you selected and, optionally, how you heard about us.

Our staff use this information to contact you, prepare and send your laboratory requisition, schedule your specimen collection, and ship at-home collection kits.

Payment information

Payments are processed by Stripe, which collects your card details and billing information directly through its own hosted checkout under its own privacy policy. We never receive or store your full card number. From Stripe we receive confirmation of your payment, the test purchased, the amount, and the last four digits of your card.

Information the laboratory collects directly

The laboratory or collection site may collect additional identifying information it requires, such as your date of birth, directly from you when it contacts you. We do not collect or hold that information.

Information we do not collect

We do not ask for or collect your medical history, current symptoms, medications, or reason for testing. Direct-access testing does not involve screening for medical necessity.

We do not receive your test results. Results are released by the laboratory directly to you.

Information collected automatically

When you visit the Site, we automatically collect technical information including your IP address, browser type and version, operating system, the pages you view, and the dates and times of your visits. Your IP address may indicate your general geographic location. We use this to operate and secure the Site and understand how it is used.

2. How We Use Your Information

  • To prepare and submit your laboratory requisition.
  • To ship at-home collection kits and direct you to a participating walk-in lab for blood-draw panels.
  • To confirm your order and respond to questions about it.
  • To respond to inquiries and schedule appointments for our clinical services.
  • To collect fees, maintain order records, and respond to payment disputes.
  • To operate, maintain, secure, and improve the Site.
  • To send administrative messages and, where you have opted in, informational or promotional communications you can unsubscribe from at any time.
  • To comply with legal, regulatory, and professional obligations, and to detect and prevent fraud or misuse.

We do not use the information you provide for unrelated purposes without telling you first.

3. Text Messages

If you provide your mobile number and consent to text messaging, we use it only to communicate with you about your order, your test, or your appointments.

We do not sell, trade, or share your mobile information or your text messaging consent with third parties for their marketing purposes. Your mobile number and messaging consent are used strictly for communications with Proactive Functional Care LLC.

Message and data rates may apply. Reply STOP to any message to opt out, or contact us using the details in Section 13.

4. How We Share Your Information

We do not sell your personal information. We share it only as needed to provide the service, including with:

  • Laboratories and their authorizing physicians. To process a direct-access test, we transmit your name, contact information, and selected test to the performing laboratory. The laboratory authorizes the requisition through its own network physician and releases results directly to you. Laboratories currently used include Diagnostic Solutions Laboratory (GI-MAP and the Sensitivity & Allergy Panel) and Precision Analytical (DUTCH Complete and DUTCH CAR).
  • Participating walk-in lab locations. For blood-draw panels, your requisition is honored at participating collection sites, which receive the information needed to identify you and perform the draw. Draw fees are paid by you directly to the collection site under its own terms.
  • Fullscript, which fulfills and ships at-home collection kits and, if you follow a supplement ordering link from our Site, collects your information under its own privacy policy.
  • Stripe, our payment processor.
  • Service providers supporting our operations — website hosting, scheduling and records systems, and email delivery — permitted to use your information only to perform services for us.
  • Legal and safety recipients — when required by law, subpoena, court order, or regulation, or to protect the rights, safety, or property of our customers, our practice, or others.
  • Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy.

Sharing of medical information created in a clinical treatment relationship is governed separately by Ohio law and our professional confidentiality obligations.

5. Health Information

Because direct-access testing does not create a practitioner-patient relationship, the information you provide when ordering a test is consumer health information rather than clinical medical record information. We treat it as sensitive regardless: we limit access to it, share it only as described in Section 4, and do not use it for advertising or sell it to anyone.

If you separately become a patient in a clinical treatment relationship with the practice, the medical information created in that context is confidential under Ohio law and our professional obligations as licensed clinicians, and is handled separately from the information described in this Policy.

6. Cookies and Tracking

A “cookie” is a small data file a website places on your device. We use cookies to keep the Site functioning, remember your preferences, and understand how the Site is used.

We also work with third-party providers who set cookies and similar technologies — such as web beacons and pixel tags — to collect information about how visitors use the Site, including your IP address, device and browser type, the pages you viewed, and the times of your visits. We use this information in aggregate to improve the Site.

We do not permit these providers to collect information about the specific tests you view or select.

Most browsers let you refuse or delete cookies through their settings, and many analytics providers offer their own opt-out tools.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information, including encrypted transmission of the information you submit through the Site. No method of transmission or storage over the internet is completely secure, however, and we cannot guarantee absolute security.

Please do not send health information, test results, or other sensitive medical details through our website contact form or by ordinary email. These channels are not encrypted. Contact the office directly to share that information securely.

8. Data Retention

We keep order records — your contact details, address, and what you purchased — for as long as needed to fulfill your order, support tax and accounting obligations, and respond to any payment dispute, and thereafter as required by applicable law. Records created in a clinical treatment relationship are retained under the medical-record retention requirements of Ohio and federal law. When information is no longer needed, we securely dispose of it.

9. Your Choices and Rights

  • Access and correction — you may request access to, or correction of, the personal information we hold about you.
  • Deletion — you may request that we delete your order information, subject to records we are required to retain by law.
  • Marketing opt-out — unsubscribe from promotional emails at any time using the link in those messages or by emailing us. We process requests within 10 business days.
  • Text messaging opt-out — reply STOP, as described in Section 3.
  • Cookie controls — manage cookies through your browser settings, as described in Section 6.
  • Test results — results are held by the performing laboratory, not by us. Requests concerning your results should be directed to that laboratory.
  • Medical records — records from a clinical treatment relationship are handled under applicable Ohio law, not under this Policy. Contact the office directly to request them.

Residents of certain U.S. states, and of the European Economic Area or United Kingdom, may have additional rights regarding their personal information. Contact us using the details below and we will respond in accordance with applicable law.

10. Age Requirement and Children’s Privacy

Direct-access lab testing through the Site is available only to adults 18 and older. Testing for a minor must be arranged directly with the practice by a parent or legal guardian.

We do not knowingly collect personal information from children under 13 through the Site. If you believe a child has provided information through the Site, contact us so we can remove it.

11. Third-Party Links

The Site links to third-party websites and services, including our payment processor, our fulfillment partner, and the laboratories that perform testing. We do not control those sites and are not responsible for their privacy practices. We encourage you to review the privacy policy of any third-party site you visit.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Effective date” above and post the updated Policy on this page. Your continued use of the Site after changes take effect means you accept the revised Policy.
